These Terms and Conditions (“Terms”) govern access to and use of the official Platform, mobile application(s), parent portals, and any other digital platforms operated or made available by AV. Meiyappan Matriculation Higher Secondary School, Chennai, Tamil Nadu, India (“School”, “we”, “us”, or “our”), whether accessed through a computer, mobile device, or any other electronic medium (collectively, the “Platform”).

By accessing, browsing, or using the Platform in any manner, including submitting enquiries, providing information, or making online payments, you (“User”, “you”) acknowledge that your use of the Platform is subject to these Terms, together with the School’s Privacy Policy and other applicable policies published on the Platform from time to time.

  1. DEFINITIONS AND INTERPRETATION

    1. “School”, “We”, “Our”, or “Us” means AV. Meiyappan Matriculation Higher Secondary School, having its campus at Chennai, Tamil Nadu, India.

    2. “User”, “You”, or “Your” means any parent, guardian, student, prospective applicant, or visitor who accesses or uses the Platform in any manner.

    3. “Student” means a child who is enrolled or seeking enrolment in the School.

    4. “Policies” means the policies of the School published on the Platform from time to time, including but not limited to the Privacy Policy, Fee Policy, and Admission Policy.

    5. “Platform” means the official Platform, mobile application(s), parent portals, online systems, and any other digital interfaces or electronic platforms operated or authorised by the School, including all associated pages, sub-domains, content, features, and services made available from time to time.

    6. References to “including” or “includes” shall be construed as illustrative and not exhaustive. Words importing the singular shall include the plural and vice versa. Headings are inserted for convenience only and shall not affect interpretation. References to any law shall include amendments, modifications, or re-enactments thereof.

  2. ACCEPTANCE AND BINDING EFFECT

    1. By accessing, browsing, or using the Platform in any manner, the User expressly acknowledges that the User has read, understood, and agreed to be bound by these Terms, the Privacy Policy, and all Policies issued by the School from time to time.

    2. These Terms constitute a legally binding agreement between the User and the School in accordance with the Indian Contract Act, 1872.

    3. If the User does not agree to any part of these Terms, the User shall immediately discontinue access to and use of the Platform.

    4. Continued access to or use of the Platform following any modification of these Terms or the Policies shall be deemed to constitute acceptance of such modified Terms or Policies.

  3. PURPOSE AND SCOPE OF THE PLATFORM

    1. The Platform is intended solely to provide general information about the School, including details relating to academic programmes, facilities, activities, admissions, events, and announcements.

    2. Information made available on the Platform is for informational purposes only and shall not be construed as an offer, representation, assurance, or legally binding commitment by the School, unless expressly stated otherwise in writing.

    3. The Platform shall not be treated as an official or exclusive mode of communication for matters relating to academics, examinations, schedules, compliance requirements, or student obligations, and official communications issued by the School through recognised channels shall prevail.

    4. The School reserves the right, at its discretion, to modify, update, suspend, or discontinue any part of the Platform, its content, or features at any time without prior notice.

  4. ELIGIBILITY AND USE BY PARENTS / GUARDIANS

    1. The Platform may be accessed and used by parents or legal guardians on behalf of Students who are minors, and such access shall be deemed to be with lawful authority.

    2. By accessing or using the Platform on behalf of a Student, the parent or legal guardian represents and warrants that they are legally entitled to act on behalf of such Student and shall be responsible for all actions, submissions, and communications made through such use.

    3. Students who are minors shall not independently use the Platform without the knowledge and supervision of their parent or legal guardian.

    4. The School shall not be responsible for any unauthorised access or use of the Platform by a Student or third party without the consent or supervision of the parent or legal guardian.

  5. ACCURACY OF INFORMATION AND UPDATES

    1. While the School endeavours to ensure that the information made available on the Platform is accurate, complete, and current, the School does not warrant or guarantee the accuracy, completeness, reliability, or timeliness of such information at all times.

    2. Information displayed on the Platform may be subject to change, revision, or correction without prior notice, and the School reserves the right to update, modify, or remove any content as and when deemed necessary.

    3. The School shall not be liable for any consequences arising from reliance placed on information available on the Platform, and Users are advised to verify critical information through official communications or by contacting the School directly.

  6. ADMISSIONS DISCLAIMER

    1. Any information relating to admissions, eligibility criteria, application process, timelines, or availability of seats displayed on the Platform is provided for general guidance only and shall not be construed as a guarantee, assurance, or right to admission.

    2. Admission to the School shall be subject to fulfillment of eligibility requirements, availability of seats, verification of information and documents, the School’s admission policies, and compliance with applicable laws, regulations, and educational board norms.

    3. The School reserves the right to accept, defer, or reject any application for admission in accordance with its policies and applicable legal requirements, and no claim shall lie against the School on the basis of information published on the Platform.

  7. FEES AND CHARGES

    1. The fees payable by Students, including tuition fees and any other charges, shall be determined and notified by the School management from time to time, in accordance with applicable laws, regulations, and directions issued by competent authorities.

    2. Any information relating to fees, payment schedules, concessions, or refunds displayed on the Platform is indicative in nature and subject to revision, and the official communications and policies issued by the School shall prevail.

    3. Revision of fees, if any, shall be communicated through official channels of the School and shall be applicable in accordance with the School’s policies and applicable legal requirements.

  8. ONLINE PAYMENTS

    1. The Platform may facilitate online payments towards fees or other charges through third-party payment gateways or service providers authorised by the School.

    2. The School does not operate, control, or guarantee the performance of such third-party payment gateways and shall not be responsible for any technical failures, transaction errors, delays, duplicate debits, or interruptions arising from their systems or networks.

    3. Users are advised to retain transaction confirmations, receipts, or reference numbers generated at the time of payment for record-keeping and for addressing any payment-related queries.

    4. In the event of any payment-related discrepancy, Users shall promptly notify the School through official communication channels, and resolution shall be subject to verification and the policies of the concerned payment service provider.

  9. ELECTRONIC COMMUNICATION

    1. The School may communicate with parents or legal guardians through electronic means, including but not limited to email, SMS, messaging applications, or notifications published on the Platform, for informational, administrative, or operational purposes.

    2. Such electronic communications shall be deemed to be valid, lawful, and effective communication by the School, and Users acknowledge that they are responsible for ensuring that their contact details provided to the School are accurate and up to date.

    3. The School shall not be responsible for any non-receipt of electronic communications arising from incorrect contact details, technical issues, service provider limitations, or factors beyond the School’s reasonable control.

  10. USER OBLIGATIONS AND ACCEPTABLE USE

    1. Users shall use the Platform only for lawful purposes and in a manner that does not infringe the rights of the School or any third party.

    2. Users shall not misuse the Platform, attempt unauthorised access to any part of the Platform, interfere with its functioning, or engage in any activity that may compromise the security, integrity, or availability of the Platform or its content.

    3. Users shall not upload, transmit, or publish through the Platform any content that is unlawful, misleading, defamatory, obscene, harmful, or otherwise objectionable, or that violates applicable laws or regulations.

    4. The School reserves the right to restrict, suspend, or terminate access to the Platform, without prior notice, in the event of any misuse or violation of these Terms.

  11. INDEMNITY

    1. The User agrees to indemnify, defend, and hold harmless the School, its management, trustees, employees, and representatives from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

      1. the User’s breach of these Terms or any applicable law;

      2. misuse of the Platform or unauthorised access thereto;

      3. submission of false, incorrect, misleading, or unlawful information or content through the Platform; or

      4. any act or omission by the User that causes harm or loss to the School or any third party.

    2. This obligation shall survive termination or cessation of use of the Platform.

  12. PHOTOGRAPHS, VIDEOS, AND MEDIA CONTENT

    1. Photographs, videos, and other media content displayed on the Platform relate to academic, co-curricular, cultural, and institutional activities of the School and are published for informational, institutional, and archival purposes.

    2. Such media content shall not be construed as commercial exploitation of any Student, parent, or member of the School community, and publication on the Platform does not imply endorsement or consent for any third-party use.

    3. Any concerns or objections relating to the display of photographs or videos on the Platform may be communicated to the School through official channels, and the School shall address such concerns in accordance with its policies and applicable laws.

  13. INTELLECTUAL PROPERTY RIGHTS

    1. All content available on the Platform, including but not limited to text, images, photographs, videos, logos, names, trademarks, graphics, design elements, and layout, is the intellectual property of the School or is used with lawful permission.

    2. Nothing contained on the Platform shall be construed as granting any licence or right, whether express or implied, to use any intellectual property of the School without its prior written consent.

    3. Users shall not copy, reproduce, modify, distribute, publish, transmit, or otherwise exploit any content from the Platform for commercial or public purposes without the express written permission of the School.

  14. THIRD-PARTY LINKS

    1. The Platform may contain links to third-party Platforms, platforms, or resources that are provided solely for the convenience of Users.

    2. The School does not control, endorse, or assume responsibility for the content, accuracy, policies, or practices of any third-party Platforms, and access to such Platforms shall be at the User’s own risk.

    3. The School shall not be liable for any loss, damage, or consequences arising from the User’s access to or reliance on any third-party Platforms or resources linked on the Platform.

  15. PRIVACY POLICY

    1. All personal data and information collected, processed, or stored through the Platform shall be governed exclusively by the School’s Privacy Policy, which is published separately on the Platform.

    2. Users are advised to read and understand the Privacy Policy to become aware of the manner in which personal data is collected, used, stored, and protected by the School.

    3. Nothing contained in these Terms shall be construed as limiting or overriding the provisions of the Privacy Policy, and in the event of any inconsistency, the Privacy Policy shall prevail with respect to personal data matters.

  16. DISCLAIMER OF WARRANTIES

    1. The Platform and all information, content, and services made available through it are provided on an “as is” and “as available” basis. 

    2. The School expressly disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, non-infringement, or uninterrupted availability. 

    3. The School does not warrant that the Platform will be error-free, secure, or free from viruses or other harmful components.

  17. LIMITATION OF LIABILITY

    1. To the maximum extent permitted under applicable law, the School shall not be liable for any loss or damage, whether direct, indirect, incidental, consequential, or special, arising out of or in connection with the use of, or inability to use, the Platform or reliance on any information made available on the Platform.

    2. Without prejudice to the foregoing, the School shall not be responsible for any loss, damage, or inconvenience caused due to technical failures, system errors, unauthorised access, or interruptions in the availability of the Platform.

    3. Nothing contained in these Terms shall exclude or limit the School’s liability to the extent such exclusion or limitation is not permitted under applicable law.

  18. PLATFORM AVAILABILITY AND MAINTENANCE

    1. The School endeavours to ensure that the Platform is accessible and functional at all times; however, the School does not guarantee uninterrupted, timely, secure, or error-free access to the Platform.

    2. Access to the Platform may be temporarily suspended, restricted, or interrupted for maintenance, updates, technical issues, or reasons beyond the School’s reasonable control, without prior notice.

    3. The School shall not be liable for any loss, inconvenience, or disruption suffered by Users as a result of such suspension, restriction, or interruption of access to the Platform.

  19. FORCE MAJEURE

    1. The School shall not be liable for any failure or delay in performance of its obligations under these Terms, or for any interruption or unavailability of the Platform, where such failure, delay, or interruption is caused by events beyond the reasonable control of the School, including but not limited to acts of God, natural disasters, epidemics or pandemics, fire, flood, war, riots, strikes, labour disturbances, governmental orders, power failures, internet or network disruptions, or failure of third-party service providers. The duration of such event shall extend the time for performance to the extent affected by such event.

  20. USER-SUBMITTED INFORMATION

    1. Users are responsible for ensuring that all information, data, and details submitted through the Platform, including enquiry forms, applications, or payment-related information, are true, accurate, complete, and up to date.

    2. The School shall not be responsible for any consequences arising from incorrect, incomplete, misleading, or outdated information submitted by Users through the Platform.

    3. The School reserves the right to verify, reject, or require clarification of any information submitted through the Platform in accordance with its policies and applicable laws.

  21. MODIFICATION OF TERMS

    1. The School reserves the right to amend, update, or modify these Terms at any time, as may be required to reflect changes in law, policy, or the operation of the Platform.

    2. Any such modification shall become effective upon publication of the revised Terms on the Platform, and the “Last Updated” date shall be revised accordingly.

    3. Continued access to or use of the Platform after publication of the modified Terms shall be deemed to constitute acceptance of such modified Terms by the User.

  22. COMPLIANCE WITH LAWS AND REGULATIONS

    1. All information, content, policies, and activities referenced or made available on the Platform shall be subject to and construed in accordance with applicable laws, regulations, rules, and directions issued by competent authorities, including educational boards and statutory bodies.

    2. The School shall have the right to modify its practices, policies, or disclosures on the Platform to ensure compliance with any change in law or regulatory requirement, without incurring any liability to Users.

    3. In the event of any inconsistency or conflict between the information available on the Platform and applicable laws or regulatory directions, the provisions of such laws or directions shall prevail.

  23. SEVERABILITY AND NO WAIVER

    1. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, such provision shall be deemed to be severed, and the remaining provisions shall continue to remain in full force and effect.

    2. Any failure or delay by the School in enforcing any provision of these Terms shall not be construed as a waiver of such provision or of the School’s right to enforce the same at any time thereafter.

  24. GOVERNING LAW AND JURISDICTION

    1. These Terms shall be governed by and construed in accordance with the laws of India.

    2. Subject to applicable law, the courts at Chennai, Tamil Nadu, shall have exclusive jurisdiction over any dispute, claim, or proceeding arising out of or in connection with these Terms or the use of the Platform.

  25. For any queries relating to the Platform, Users may contact the School through official contact details published on the Platform.

These Terms and Conditions, together with the Privacy Policy and other applicable policies of the School, constitute the complete and binding terms governing access to and use of the Platform. Users are advised to review these Terms periodically to remain informed of any updates or modifications. Continued use of the Platform shall be deemed to constitute acceptance of the Terms as amended from time to time.
